Fitzters is a health and fitness tracking application that allows users to track nutrition through images and voice. The Platform includes Artificial Intelligence ("AI") features that analyze user inputs to generate nutritional insights.

2. Information We Collect

A. Personal Information You Provide

We collect personal information voluntarily provided by you, including but not limited to:

• Name
• Email address
• Physical attributes (weight, height, age, gender) for calorie calculations
• Fitness goals and preferences

You may choose not to provide certain information, but doing so may limit the functionality of the Service.

B. Health Content & User Inputs

To operate Fitzters, we process:

• Meal logs and descriptions
• Text and voice inputs to AI features
• Calorie and macro targets
• Uploaded photos of meals or fitness progress

C. Usage Data & Device Information

• Device model, OS, browser type
• Time and duration of sessions

3. Purpose of Data Processing

4. AI Processing & Third-Party Services

Fitzters integrates with third-party AI processors (such as OpenAI, Google, Anthropic, or similar providers) to analyze your food photos and voice inputs. You acknowledge and agree that:

1. Your photos, voice recordings, and text inputs will be transmitted to third-party AI providers for processing and analysis.
2. These third-party providers may retain your data according to their own privacy policies and data retention practices.
3. While we anonymize or pseudonymize information when possible, photos and free-text fields may still contain identifiable information depending on what you choose to upload or enter.
4. We do not sell or license your personal content to third parties.
5. We do not allow public AI models to be trained on your identifiable personal information.
6. AI analysis may be inaccurate and should not be relied upon for medical, dietary, or health decisions.
7. Third-party AI providers operate under their own terms of service and privacy policies, which you should review.

5. Disclosure of Data

We may share data in the following circumstances:

A. Service Providers

Hosting, analytics, AI processors (OpenAI, Google, Anthropic, etc.), cloud storage (Firebase, Google Cloud), and security providers may access data strictly as needed to operate the Service. These providers are contractually obligated to protect your information.

B. Legal Compliance

We may disclose information to governmental authorities if required by applicable laws or regulations, lawful court orders, or requests relating to safety or fraud investigations. This is limited to jurisdictions applicable to Canada and to where data is stored or processed.

C. Business Transfers

We retain information as long as your account remains active, as required for legal compliance, and as needed to enforce agreements or resolve disputes.

You are responsible for:

• Only uploading photos of your own food and progress (not other people's photos without consent)

• Understanding that AI-generated information may be inaccurate

11. No Liability for Health Outcomes

You acknowledge and agree that:

• The Service cannot guarantee weight loss, muscle gain, or any specific health outcome
• AI-generated nutritional information may be incorrect
• The Service is not a substitute for professional medical, nutritional, or dietary advice
• EverSeed Ventures is not responsible for any health issues, medical conditions, injuries, or adverse outcomes that may occur while using or as a result of using the Service
• You should consult with qualified healthcare professionals before making any health-related decisions

12. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by posting the new Privacy Policy on this page and updating the "Last Updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Privacy Policy.
